Waiver

I hereby agree to the following: 1. I am participating in classes or services during which I will receive information and instruction about wellness and health. I recognize that activities I participate in require physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved. 2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any physical fitness program. I represent and warrant that I have no medical condition that would prevent my participation in physical fitness activities. 3. In consideration if being permitted to participate in the offered classes, I agree to assume full responsibility for any risks, injuries or damages, known and unknown, which I might incur as a result of participating in the program. 4. In further consideration of being permitted to participate in the offered classes, I knowingly, voluntarily, and expressly waive any claim I may have against the instructor, the owner, or the leaseholder of the building for injuries or damages that I may sustain as a result of participating in classes or workshops. 5. I hereby grant permission to use my likeness in a photograph, video or other digital media in any and all of it’s publications, including web-based publications and marketing without payment or other consideration. I have read and fully understand and agree to the above terms of this Liability Waiver Agreement. I am digitally signing this agreement voluntarily and recognize that my digital signature serves as complete and unconditional release of all liability.

If you breach these Terms and we take no action against you, or if we delay in doing so, that will not mean that we have waived our rights against you and we will still be entitled to enforce our rights and remedies against you in relation to that breach and to use our rights and remedies in any other situation where you breach these Terms.

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the remainder of the Terms will continue to govern each of our respective obligations.

These Terms are not intended to give rights to anyone except you and us.

Except as otherwise expressly stated, these Terms and our Privacy Policy contain the entire agreement between us, the Publisher and you relating to use of the App and supersede any previous agreements,

Subscriptions

Terms of Monthly Subscription: Mindful Monday Membership monthly subscriptions are charged every month and provide member access for a month. To cancel subscription, please do so on om.rishiyoga.org

Subscription cancellations will not be prorated.

Terms of Annual Subscription: Mindful Monday Membership Annual subscriptions are charged annually and provide member access for one year. To cancel subscription, please do so on om.rishiyoga.org

Indemnification

You hereby indemnify to the fullest extent Rishi Yoga from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

Variation of Terms

Rishi Yoga is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

Assignment

The Rishi Yoga is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Entire Agreement

These Terms constitute the entire agreement between Rishi Yoga and you in relation to your use of this Website, and supersede all prior agreements and understandings.

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the State of Idaho, and you submit to the non-exclusive jurisdiction of the state and federal courts located in us for the resolution of any disputes.
